You represent and warrant that you have all necessary rights and permissions to submit the content and that such content does not infringe any third party’s rights.

3. Reporting Copyright Infringements

If you believe that any content on our website infringes your copyright or the copyright of someone you represent, you may submit a notice to our designated Copyright Agent at the contact information provided below. Your notice must include the following:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
• Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
• Identification of the material that is claimed to be infringing or the subject of infringing activity and that is to be removed or access to which is to be disabled, along with information reasonably sufficient to permit us to locate the material.
• Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and an email address.
• A statement that the complaining party has a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Counter-Notification

If your content has been removed from the Apollos Gold website due to a copyright infringement claim and you believe that the removal was in error or that you have the right to use the material, you may submit a counter-notification to our Copyright Agent. The counter-notification must include the following:

• Your physical or electronic signature.
• Identification of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled.
• A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
• Your name, address, telephone number, and email address, along with a statement that you consent to the jurisdiction of the federal court in your judicial district and that you will accept service of process from the person who provided the original infringement notification.

Upon receipt of a valid counter-notification, we will forward it to the person who filed the original copyright claim. If we do not receive notice of a court action from the original claimant within [10] business days, we will restore the removed content.

5. Repeat Infringers

Apollos Gold reserves the right to terminate the accounts of users who are found to be repeat infringers of copyright, according to our discretion and applicable law.
